1. Warranty and Remakes

1.1 Warranty Coverage

• Fixed and removable prosthetics: Covered for 2 years against defects in materials or workmanship.
• Temporary restorations and orthodontic appliances: Covered for 6 months.
• All products must conform to the dentist’s original prescription.

1.2 Exclusions and Limitations

The warranty does not cover:

• Clinical failures due to improper adjustments, poor oral hygiene, or supporting tooth/tissue failure.
• Cases fabricated from questionable impressions, margins, or bites when the Laboratory recommended a remake and the Client elected to proceed.
• Cases where required protocols (e.g., try-ins, verification jigs) were declined.
• Restorations modified by anyone other than the Laboratory.
• Damage due to neglect, abuse, accidents, or patient misuse.
• Restorations fabricated in whole or in part by another laboratory.

1.3 Remake Policy

• Eligible cases will be remade at no charge if within warranty coverage and exclusions do not apply.
• Additional fees may apply for remakes outside warranty scope or due to clinical/prescription errors.
• Warranty claims require the original restoration and model to be returned to the Laboratory.

1.4 Account Standing Requirement

Warranty coverage applies only if the Client’s account is in good standing at the time of the claim.

2. Payment and Accounts

2.1 Billing and Fees

• Invoices are due within 30 days of statement date.
• Overdue accounts are subject to a 1.5% monthly service charge (18% annual rate) or the maximum permitted by law.
• Returned checks are subject to a return fee.

2.2 Collections

• The Laboratory may place delinquent accounts on hold, requiring payment before shipping new cases.
• The Laboratory reserves the right to use collection services and recover attorney’s fees and court costs related to collection.

2.3 Financial Policies

• No cash refunds.
• Credits may be issued at the Laboratory’s discretion if a case does not meet quality standards.
• Warranty claims will not be honored on accounts with outstanding balances.

3. Case Submission and Cancellation

3.1 Case Submission

• All impressions and models must be disinfected before submission. The Laboratory may refuse or charge a fee for improperly disinfected cases.
• The Laboratory is not responsible for errors resulting from incomplete or inaccurate prescription forms.

3.2 Cancellations

• Cases canceled mid-production will incur charges based on the percentage of work completed.

4. Liability and Disclaimers

4.1 Limitation of Liability

The Laboratory’s sole obligation is limited to the repair or replacement of defective products covered under warranty.

4.2 Exclusions

• The Laboratory is not liable for indirect or consequential damages, including lost wages, chair time, or patient-related claims.
• Warranty coverage is non-transferable and applies only to the prescribing dental practice.

5. Legal and Governing Terms

5.1 Governing Law

These Terms and Conditions shall be governed by and construed under the laws of the State of [Insert State].

5.2 Litigation and Arbitration

• In the event of a dispute, the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs.
• The Client may be required to resolve disputes through binding arbitration, and both parties waive the right to a jury trial, unless prohibited by applicable law.

Submission of a case to Keramos Dental Laboratory LLC constitutes acknowledgment and acceptance of these Terms and Conditions.
